Hi,
I helping my employer filling the I-129 B-1B Data collection supplement form. In Part C Question 8 Item 4:
Is this the second or subsequent request for an extension of stay that you have filed for this alien?

This application is an extension (for 3 years) for my H1-B. My position in the company is the same as that when applied for my previous (first) H1-B petition.

I have NOT applied for green card/labor certification.

Is the answer Yes or No for this question?

if you have EAD, alien # is same as A# on the EAD card. otherwise i think you should fill NA or none (check instructions page,for blank, what you need to fill).

Disclaimer: I'm not an immigration attroney, so please check with one for your situations as laws/procedures are changing frequently.

I have a question on filling up this form

It asks for Alien Registration Number (In section 5) - can anyone tell me what to fill this up with, since I do not have Green card?

There is a slot for I-94 admissions# which I have filled up.

Any help will be appreciated.

I have worked for Company "A"(Ex-employer) under H1-B(company A holding my H1-b) from 2007-2010. During 2009 & 2010, company A was unable to clear all my payments as the company went through some financial hurdles but they issued W-2 for the amount paid in fiscal year 2009. Now, company A has got money and they decided to clear my back wages for 2009-2010 through 1099 form. I transferred my H1-B visa to Company B(2010) then to Company C(current employer). Now, Company C has started my Green card(GC) process.

Questions:
1. I already received W2 for 2009. Can company A amend the W2 for the back wages?
2. Is it legal to take the unpaid amount under 1099? Will it affect my GC process?
3. What are my options to get my back wages from company A?
4. Company A want to issue 1099 along with a letter stating that i was full time employee for the time period mentioned in 1099. Is it acceptable?


I really appreciate your help for taking your valuable time in clarifying my questions. I look forward for your reply.

Hi Gurus

My I-140 petition was denied 2 months back and My attorney is trying to re apply for it. In the mean while there is a query on the company it self and our attorney is working hard to get it cleared.

In the mean while I am thinking about switch the employer.

I am in 8 th year extension and My VIsa is valid until jan 2008.

1.Assuming some comany offered me to apply for I140 and 485 and join that the company, what will happen If I140 has not been cleared before Jan 2008?.

2.What are the pros and cons I should think about when I switch the company.?

Hi

My Wife was working as sole proprietor and she is planning to open Single Person LLC.

She is also planning to start her second business.

1) Can she do multiple businesses in ONE LLC?

2) Will she file multiple Schedule C for EACH business ( If you have one person LLC you can file taxes in Schedule C) ?

3) Does she has to apply for new Federal ID or she can use same she was using in Schedule C for this new LLC also?

The couple applied for the green card together. The husband applied under the EB1 category and his wife also applied with him as dependent. The green card of the couple has been approved and is expected to arrive in a month's time. The wife is not in US currently. She is outside US. Will the husband get his green card & the wife's green card in his wife's absence? Will there be any complications in the husband's green card in this case?

Hi Forum,

My wife has an H1B visa which has been invalidated now because she had to travel to US with me on H4. Her petition seem to be valid. The I94 in her passport has H4 mentioned on it. Now we want to convert her visa back to H1. Since she has H1, I am wondering the H4 to H1 conversion process should be easier compare to applying fresh H1.

It would be great if you guys let me know what is the process of converting this without going back to home country.

My I-94 extension (for L1B visa) was denied on Oct '08 and I returned in 4 days after they updated Denial status. Reason for denail is "lack of specialized knowledge". I am planning to apply for L1B again in next month (By showing additional certification). Can you please advice me

- is it fine to apply for visa again as it will be more then 6 months after it was denied

- Do I need to show the copy of denial notice during visa interview? Is there any thread available providing suggestions for those applying for visa again after it was denied earlier...
