Your attorney must have the answer. When you file an I-485, you should include a copy of the I-140 approval or receipt, so your better ask your attorney.

Hello,
There are lots of articles/news around this issue, but so far these have been exceptions than rule ... I myself entered US through a completely different airport than where I'm employed (on H-1B) and didn't have any issue.

Refugees from Sudan have a tough time with USCIS, let alone people from other nations. Refugees from Sudan have a tough time. Period. It is sad, and we should do what we can to help those less fortunate than us. Again, period. No ifs and buts about it. But is this the right forum, or even the right website?

I had applied on July 19th to Nebraska. My I-140 was approved from TX.
Today I received transfer notice WAC...., mentioning that they have transferred my case to TX Service center.
The receipt date is of Sep 14th, Notice date of Sep 17th'2007.
Does it mean I lost the original filing receipt date of July 20th'2007.

I am right now on L1A visa recently filed for extension and still in processing.
I am planning to get married to my girlfriend here and apply for greencard.

Hi folks,
My company filed for I-485 on July 2nd and I am yet to get a receipt for the same. I understand that usually it takes 1-3 months to get FP request after filing I-485 but in these circumstances, what should be the expectation for receiving FP request?
The reason for asking is because my wife is tired of waiting to do a job and is planning to go to India and work there until she gets EAD. If she leaves now and we get a FP request in her absence, what are my options?
1) Can I delay the FP appointment?
2) Can I go alone and have myself finger-printed (assuming that wife doesn't want to come back to US, that is, not interested in GC anymore)?
3) How does it impact EAD/AP which have not been filed yet but will be filed after getting the I-485 filing receipt.

Ninth circuit review pending and im seeking an extension on the opening brief until I find out bia status. The question I have is if i should just use IAC as an argument or just try to reopen based on a material change? I dont want to open a "can or worms" but the attorney throughout the 5 year court proceedure never advise to vacate or any post conviction remedies. Bia appeal decision Apr 29/09 is past the ninty days.

I filed for EAD (new application) 30 days back along with my AOS applications. Finished my FP on the 25th day.
Normally How long it take to get EAD from Texas Service center. ??
Any idea. ??
Now a days EAD is coming pretty quick. Some one got within a week. So it depends any where between 30 to 90 days.

Hello All,

My H1 expires this sept 19th 2010. I don't have the present H1 stamped.
Also, I have the new extended H1 which is valid from Sept 19th 2010.
Now, I'm planning to travel to India and go for stamping.
1. If I go for stamping before sept19th, on which H1 will i get the visa stamped,present H1 or the new extended H1?
2. Is it safe to go before sept19th or after sept 19th? I prefer the stamping on H1 extension.
I'm flexible with my travel.
I'm waiting to book my appointement based on the advice given.

I work for company A. I am on a project actively with an end client from last one year. My company A stopped paying me from past 5 months in spite of them getting paid from the vendor. I have requested my company to release all my payments pending from last 5 months repeatedly. But they don't seem to bother. I am planning to change my employer now.
My question is Am i out of status since I am not getting paid from last 5 months? I have luckily all the copies of pay stubs till a month ago. Only thing is that I haven;t received them yet. Please let me know
