    Hello,
If one has EB1 (Extraordinary Ability) Pending, is one allowed to stay in the US until the case is decided? I know it may takes at least an year for the final approval...

From its passage in 2002 until now, the USCIS has never issued so much as a memo explaining how it interprets the "automatic conversion" clause of the Child Status Protection Act (CSPA). They left it to the Board of Immigation Appeals (BIA) to explain this in Matter of Wang in 2009. The USCIS argued that the clause be interpreted in the most restrictive way possible, and surprisingly, the Board bought their argument. However, Matter of Wang may have a short shelf life, and here's why: 1) The Administrative Delays Fallacy In Matter of Wang, the Board states that we find...

The antis regularly trumpet the argument that we need to slash visa numbers to protect jobs for Americans looking for work. But if employers are seeking to slash payrolls and immigrants were a source for cheap labor, shouldn't we see visa applications increasing? The numbers tell a stark story - visa applications in key categories are plummeting. Eighteen months ago, H-1B applications for university educated workers were in such high demand that nearly 200,000 applications were received on the first day the annual allotment opened up. This past April, only 40,000 applications for the basic H-1B quota were received and...

Todays New York Times brims with immigration dysfunctions galore. The paper's immigration reports tellingly underscore the front-burner role this white-hot policy issue plays in the nation and the world. In the first section alone, we see: An open-mike faux pas by British PM Gordon Brown, referring to an immigration opponent as a bigoted woman, prompted his abject apology and now risks a Labor Party loss in the UK election next week; A controversial opinion piece and articles on the political, legal and economic fallout of the Arizona Peace-Officers Suspect-and-Arrest-or-Refrain-and-Be-Sued Act; A report on four Dream Act marchers...

Ooops... I posted my reply to the pic in the gallery! To reiterate here, I love this photo... the only distracting aspect is the deteriorating wall in the shadows on the left. I played with some creative cloning and removed it and quite liked the results. Other than that, the color, symetry and lighting all come together in a really compelling way. It's one of my personal favorites!

    Hi,

My OPT was approved and I received the approval notice. But the card itself
has been lost in mail. I have applied for a replacement card.

I am aware of something called the "I-9 receipt rule" wherein the receipt for
the replacement of a lost document can be used in place of the document itself
for a period of 90 days.

Does this apply to my case? In other words, can I use the receipt of the replacement
request to work for upto 90 days?

    Thanks in advance!

PS: I am aware that I cannot start working based on the approval notice itself.

Are you allowed to work on H1b for your primary employer and EAD for your own LLC. My wife applied for 485 as a derivative applicant. She has her H1b valid until next year. When she resumed work last year after her pregnancy she submitted her EAD card to the employer's attorney. So far she was under the impression she is now working on EAD. Suddenly the attorney calls her and tells her that they are recommending and H1 extension.

Which is fine if it is possible but in the meantime she has started her own LLC which is likely to generate revenue soon. Is it valid for her to do so while resuming H1b status? Will it be construed that she is working for her own LLC using her EAD.

    Thanks

More skilled immigrants are giving up their American dreams to pursue careers back home, raising concerns that the U.S. may lose its competitive edge in science, technology and other fields.

"What was a trickle has become a flood," says Duke University's Vivek Wadhwa, who studies reverse immigration.

Wadhwa projects that in the next five years, 100,000 immigrants will go back to India and 100,000 to China, countries that have had rapid economic growth.

"For the first time in American history, we are experiencing the brain drain that other countries experienced," he says.

The pundits are already punditizing about something folks in my own office were debating yesterday - what the nomination of the first Hispanic to the US Supreme Court means for immigration reform this year. One camp believes that Obama has "thrown a bone" to the growing, increasingly powerful Hispanic community by nominating Sotomayor and it is intended to soften the blow when he decides to pass on pushing immigration reform this year. On the other hand, appointing Sotomayor could also be viewed as further enhancing support Hispanics, particularly if Republicans foolishly seek to push back too hard against a well-qualified...

At a time of historically high unemployment rates, when it becomes convenient, even fashionable to highlight the frailties and abuses of the H-1B program, it is refreshing to take note of the feel good story of certain immigrants who have come to this country and achieved greatness and are living the American Dream. Indeed, the recent Nobel Prizes awarded this week to the first six (6) Nobel Laureates were to U.S. citizensfour of whom were born outside the United States. Perhaps we should take a closer look at the current popular theme of closing our borders to protect U.S. workers....

South Korean-born Dr. Jim Yong Kim today assumes the presidency of Dartmouth College and becomes the first Asian American to lead an Ivy League university. The physician, teacher and infectious disease expert told the Dartmouth community: It is deeply humbling for me the child of Korean immigrants from a small town in Iowa to follow in the footsteps of his predecessors and lead Dartmouth College. Here is a clip from today's inauguration:
